These Terms of Service ("Terms") govern your use of the Blood Pressure Tracker mobile application ("App") developed by Toncho Dev ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms and our Privacy Policy.

1. Acceptance of Terms

By accessing or using the Blood Pressure Tracker, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

2. Eligibility

You must be at least 13 years of age (or 16 in the European Economic Area) to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you should have permission from a parent or guardian to use the App.

3. License to Use

Subject to your compliance with these Terms, Toncho Dev grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Blood Pressure Tracker for personal, non-commercial purposes.

You may NOT:

• Copy, modify, distribute, sell, or lease any part of the App
• Reverse engineer, decompile, or attempt to extract the source code
• Remove, alter, or obscure any proprietary notices
• Use the App for any illegal or unauthorized purpose
• Interfere with or disrupt the operation of the App
• Attempt to gain unauthorized access to the App or related systems
• Use automated systems (bots, scrapers) to access the App
• Use the App to provide medical services to others

4. User Accounts

Some features may require you to create an account. When creating an account:

• You must provide accurate and current information
• You must maintain the security of your password
• You are responsible for all activities under your account
• You must notify us immediately of any unauthorized use
• You may not create multiple accounts or share your account
• Your account contains sensitive health data - protect your login credentials

We reserve the right to suspend or terminate accounts that violate these Terms.

You understand and agree that:

• NOT A MEDICAL DEVICE: This App does NOT measure blood pressure. It only records and tracks readings you enter manually or import from compatible devices
• NOT A SUBSTITUTE FOR PROFESSIONAL CARE: The App is not a substitute for professional medical advice, diagnosis, or treatment
• ALWAYS CONSULT A DOCTOR: Always consult with a qualified healthcare provider before making health-related decisions
• EMERGENCY SITUATIONS: If you experience chest pain, severe headache, shortness of breath, vision problems, or other serious symptoms, call emergency services (911) immediately - DO NOT rely on this App
• NO DIAGNOSIS: The App does not diagnose hypertension, hypotension, or any medical condition
• REFERENCE RANGES ARE GENERAL: Blood pressure ranges and classifications are for educational purposes only and may not apply to your specific situation
• DEVICE ACCURACY: We are not responsible for the accuracy of connected blood pressure monitors or manually entered data
• MEDICATION REMINDERS: Medication reminders are convenience features only - follow your doctor's prescription instructions

Important Safety Information:

• Never adjust your medications based on App data without consulting your doctor
• Follow proper blood pressure measurement techniques for accurate readings
• The App's alerts and warnings are educational - not medical advice
• Individual health conditions vary greatly - what's normal for one person may not be for another
• Pregnancy, age, medical conditions, and medications all affect blood pressure
• Single high or low readings may not be clinically significant - discuss patterns with your doctor

IF YOU EXPERIENCE ANY ADVERSE HEALTH EFFECTS OR MEDICAL EMERGENCY, DISCONTINUE USE AND SEEK IMMEDIATE MEDICAL ATTENTION.

6. Proper Use of the App

For Best Results:

• Use validated, clinically accurate blood pressure monitors
• Follow proper measurement techniques (proper cuff size, rest before measuring, etc.)
• Enter readings accurately and honestly
• Take measurements consistently at the same times
• Share your App data with your healthcare provider for professional interpretation

Do NOT Use the App:

• As your only method of monitoring blood pressure if you have hypertension
• To self-diagnose or self-treat any medical condition
• To make medication changes without doctor approval
• In place of regular medical checkups
• As an emergency medical tool

7. Free Service and Future Pricing

The Blood Pressure Tracker is currently offered with free core features. We reserve the right to:

• Introduce paid premium features or subscriptions in the future (with notice)
• Modify, suspend, or discontinue any features at any time
• Change the pricing structure with reasonable notice

Existing free features will remain free for users who download the App before any pricing changes.

8. User Content and Health Data

You may create and store content in the App, including blood pressure readings, notes, medication logs, and profile information ("User Content").

Your Responsibilities:

• You retain ownership of your User Content and health data
• You grant us a license to store and process your User Content to provide App services
• You are responsible for backing up important health data
• You must not enter false or misleading health information
• You must not post illegal, harmful, or offensive content
• Accuracy of your data is your responsibility

Our Rights and Limitations:

• We may remove User Content that violates these Terms
• We are not responsible for loss of User Content
• We recommend regular data exports (available in App settings)
• We do not verify, validate, or guarantee the accuracy of your health data

9. Connected Devices

The App may connect with Bluetooth blood pressure monitors:

• We do not manufacture or sell blood pressure monitors
• We are not responsible for device accuracy, calibration, or malfunction
• Use only clinically validated devices approved by regulatory bodies (FDA, CE, etc.)
• Follow the device manufacturer's instructions for proper use
• Device connectivity is provided "as is" without warranties

10. Health Data Integration

The App may integrate with Apple Health and Google Fit:

• Integration is optional and requires your explicit permission
• You control which data types the App can access
• You can disconnect at any time
• We comply with Apple HealthKit and Google Fit API policies
• Health data is not used for advertising or marketing
• We are not responsible for data syncing issues with these platforms

11. Third-Party Services

The App may integrate with third-party services (healthcare provider portals, telemedicine services, etc.). Your use of these services is subject to their respective terms and policies. We are not responsible for third-party services.

12. Intellectual Property

All content, features, and functionality of the App are owned by Toncho Dev or its licensors and are protected by copyright, trademark, and other intellectual property laws.

The Blood Pressure Tracker name, logo, and related marks are trademarks of Toncho Dev. You may not use these marks without our prior written permission.

13. Privacy and Data Protection

Your privacy is important to us, especially regarding sensitive health data. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

14. Disclaimers and Limitations of Liability

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability and fitness for a particular purpose
• Non-infringement of third-party rights
• Accuracy, reliability, or completeness of information
• Uninterrupted or error-free operation
• Accuracy of blood pressure data or calculations
• Suitability for medical or diagnostic purposes

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TONCHO DEV SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenues, data, or use
• Personal injury, health complications, or death arising from using the App
• Medical decisions made based on information from the App
• Failure to seek medical attention due to reliance on the App
• Inaccurate blood pressure readings or data
• Missed medication doses despite reminders
• Delayed diagnosis or treatment
• Errors, bugs, or inaccuracies in the App
• Unauthorized access to your health data
• Third-party actions, devices, or content
• Data loss or corruption

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED $100 OR THE AMOUNT YOU PAID TO US IN THE PAST 12 MONTHS, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability, so some of the above may not apply to you. However, the health-related disclaimers apply to the maximum extent permitted by law.

15. Indemnification

You agree to defend, indemnify, and hold harmless Toncho Dev and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including attorney's fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content or health data
• Health decisions or outcomes related to App use
• Your failure to seek appropriate medical care
• Inaccurate data you enter into the App

16. Changes to the App

We continuously improve the App and may:

• Add, modify, or remove features
• Release updates and new versions
• Change the App's appearance or functionality
• Temporarily or permanently suspend the App
• Update health reference ranges based on new medical guidelines

We will make reasonable efforts to notify you of significant changes.

17. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

• Displaying a notice in the App
• Sending you an email (if provided)
• Updating the "Last Updated" date

Your continued use of the App after changes constitutes acceptance of the new Terms.

18. Termination

Either party may terminate this agreement at any time:

You may:

• Stop using the App and delete it from your devices
• Delete your account through App settings
• Export your health data before deletion

We may:

• Suspend or terminate your account if you violate these Terms
• Discontinue the App with reasonable notice
• Modify or restrict access to features

Upon termination, all licenses granted to you will immediately cease, and you must delete the App from your devices. We recommend exporting your health data before termination.

19. Dispute Resolution

Informal Resolution

Before filing a formal claim, please contact us at toncho.dev@gmail.com to attempt to resolve the dispute informally. Most issues can be resolved this way.

Governing Law

These Terms shall be governed by the laws of the jurisdiction in which Toncho Dev operates, without regard to conflict of law provisions.

Arbitration

Any dispute that cannot be resolved informally shall be resolved through binding arbitration, except that either party may seek injunctive relief in court for intellectual property matters.

Class Action Waiver

You agree that disputes will be resolved individually and not as part of a class, consolidated, or representative action.

20. Apple App Store Terms

If you download the App from the Apple App Store:

• These Terms are between you and Toncho Dev, not Apple
• Apple has no obligation to provide maintenance or support
• Apple is not responsible for the App or any claims relating to it
• Apple is a third-party beneficiary of these Terms
• You must comply with Apple's App Store Terms of Service

21. Google Play Store Terms

If you download the App from Google Play:

• You must comply with Google Play's Terms of Service
• These Terms shall be interpreted in accordance with Google Play Terms

22. Regulatory Compliance

The Blood Pressure Tracker is a general wellness app and is not intended to be a medical device regulated by the FDA, EMA, or other regulatory bodies. It does not:

• Diagnose, treat, cure, or prevent any disease
• Replace medical devices or professional medical care
• Provide real-time monitoring for medical emergencies
• Make therapeutic recommendations

23. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

24. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Toncho Dev regarding the Blood Pressure Tracker and supersede all prior agreements.

25. Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

26. Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms at any time without restriction.

27. Export Compliance

You may not use or export the App except as authorized by U.S. law and the laws of the jurisdiction in which the App was obtained.

28. Feedback

We welcome your feedback and suggestions! If you provide us with ideas, suggestions, or feedback about the App, you grant us the right to use and incorporate such feedback without any obligation or compensation to you.
